But the dispute is far from resolved. Pimentel has asked the Senate Electoral Tribunal to decide on the protest he filed against Zubiri based on the outcome of the vote recount which supposedly showed he was the real winner of the 12th senatorial seat.
Strangely enough, the SET has not officially released its latest resolution on the case. Supposedly, the protagonists were restrained by the tribunal from publicly commenting on the status of the protest through a gag order. Back in MayPimentel, armed with documentary evidence of cheating, filed a motion with the Commission on Elections to stop the fraudulent Maguindanao votes from being tabulated and to look into the alleged rigging of results.
It was intended to prevent Zubiri from overtaking him in the 12th winning slot.

But the Comelec turned down his motion. Based on the Comelec count, Zubiri was credited withor about 95 percent of thevotes cast in Maguindanao which was a statistical improbability.
When Pimentel appealed to the Supreme Court, it upheld the adverse order of the poll body. This left Pimentel with no other recourse but to elevate his case to the Senate Electoral Tribunal. Covered by his electoral protest were 2, precincts in Maguindanao and other Mindanao provinces. But Zubiri filed a counter-protest covering about 75, precincts or nearly a third of all polling precincts in the country. Sometime in Julythe tribunal ruled that there was solid evidence of fraud and allowed a recount in the remaining 75 percent of the covered precincts.
Based on result of the recount, Pimentel supposedly established a lead of almostover Zubiri. But the young Pimentel has discreetly refrained from publicly discussing the latest SET order due to the gag order. The tribunal is composed of three justices and six senators. The elder Pimentel told the Kapihan audience: By allowing Zubiri to go on with the recount in 75 percent of his protested areas, the majority of the SET tried to pre-empt the action of the succeeding composition of the new tribunal.
Even if he is allowed to proceed, his initial estimate is to the effect that even if he would succeed, there may be 45, questionable votes, which could go either way—to him or Koko.
Koko was expected to file a motion for reconsideration of the SET ruling. Or perhaps, he may have already done so by this time.
This would further prolong the recount.
